In consideration of the services provided by Lynn Family Farm, LLC (hereinafter referred to as “LFF”), including its agents, owners, officers, volunteers, employees, and all other individuals or entities acting on their behalf, I hereby agree to release, indemnify, and discharge LFF on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives, and estate as follows:
I acknowledge that my participation in activities such as hayrides, barrel train rides, the corn maze, the pumpkin patch, the big slide and stairs, corn box interactions, as well as engaging with chickens or goats, involves known and unanticipated risks that may result in physical or emotional injury, paralysis, death, or damage to myself, my property, or third parties. I understand that such risks cannot be completely eliminated without compromising the essential nature of these activities.
These risks include, but are not limited to: slips and falls; negligence of other participants or myself; adverse weather conditions; falls from heights; severe injuries such as head, neck, and back injuries; internal organ injuries; loss of fingers or other appendages; dislocations; pinched fingers; rope burns; scrapes; exposure to sun and extreme weather conditions that may lead to hypothermia, heat-related illnesses, heat exhaustion, sunburn, and dehydration; encounters with potentially dangerous wildlife, insect bites, and hazardous plant life; equipment failure; negligence by other participants or individuals present; natural forces, including lightning and rapid weather changes; transmission of pathogens or diseases; my own physical condition; and the physical exertion associated with these activities. Should I or my child sustain an injury, any medical assistance required will be at my own expense.
I expressly agree to accept and assume all risks associated with this activity. My participation is entirely voluntary, and I choose to engage in these activities despite the risks involved.
I hereby voluntarily release, discharge, and agree to indemnify and hold harmless LFF from any and all claims, demands, or causes of action connected with my participation in this activity or my use of LFF's equipment or facilities, including claims alleging negligent acts or omissions by LFF.
Should LFF or any representative be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
I certify that I possess adequate insurance to cover any injury or damage I may cause or suffer while participating, or I agree to bear the costs of such injury or damage myself. I further certify my willingness to assume the risks associated with any medical or physical condition I may have.
Should I file a lawsuit against LFF, I agree to do so exclusively in the state of Georgia, and I acknowledge that the substantive law of that state will govern the action, without regard to its conflict of law rules. If any portion of this agreement is deemed void or unenforceable, the remaining provisions shall remain in full force and effect.
Lynn Family Farm Participation Agreement, Release, and Assumption of Risk By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against LFF on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at LFF. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms and conditions.
